1. GENERAL TERMS AND CONDITIONS
   • This Public Offer for the provision of a charitable donation (hereinafter referred to as the “Offer”) is an offer of the Charitable Organization “Charitable Foundation “LIFE AND SAFETY”, identification code 45377791, with an office in Ukraine, 03187, Kyiv, Ak. Glushkova Ave. 49, office 60 (hereinafter referred to as the “Fund”), represented by its director Natalia Yakushova, to an unspecified number of legally capable individuals and legal entities under private law to conclude an Agreement for the provision of a charitable donation (hereinafter referred to as the “Agreement”) on the terms specified in this Offer.
   • This proposal to conclude the Agreement is a public offer in accordance with Article 641 of the Civil Code of Ukraine.
   • This Offer comes into force from the moment of its publication on the Fund's website. https://life-and-safety.com   (hereinafter referred to as the “Site”).
   • This Offer is indefinite and may be amended or withdrawn by the Foundation at any time (prior to its acceptance by the Benefactor) by publishing relevant information on the Website.
2. SUBJECT OF THE AGREEMENT
   • In accordance with this Agreement, the Benefactor transfers funds to the ownership of the Foundation free of charge, and the Foundation accepts them and undertakes to use them to achieve the goals defined by its Charter.
   • The transfer of funds by the Benefactor in accordance with the terms of this Agreement is considered a charitable donation in accordance with the Law of Ukraine "On Charitable Activities and Charitable Organizations".
   • The Benefactor provides the Foundation with a charitable donation that does not involve the Benefactor receiving profit, nor the payment of any remuneration or compensation to the Benefactor from or on behalf of the Foundation. The Foundation receives the charitable donation from the Benefactor on a voluntary, non-refundable and gratuitous basis.
   • The Benefactor has the right to independently determine the amount of the charitable donation. The Foundation independently decides the purpose of using charitable donations within the framework of its statutory activities, unless the Benefactor has established otherwise for the purposes of payment.
3. GOALS AND AREAS OF CHARITY ACTIVITIES
   • The Foundation carries out charitable activities in accordance with the goals defined by its Charter, the main of which are: providing assistance to promote the legitimate interests of beneficiaries in the areas of charitable activity defined by the Charter of the Foundation and current legislation, as well as the development and support of these areas in the public interest.
4. ACCEPTING THE OFFER AND MAKING A CHARITABLE DONATION
   • The Benefactor and the Foundation agree that the Agreement shall be deemed to be concluded in writing upon acceptance of the offer. The Parties agree that failure to comply with the written form of the Agreement shall not render it invalid.
   • The Offer is deemed accepted after the Benefactor transfers the charitable donation funds to the Foundation, as specified in clause 4.3 below.
   • A benefactor can make a charitable donation by:

• transfer of funds using payment forms and means available on the Site;
• transfer of funds to the Fund's current account through banking institutions.
  • A benefactor can make a one-time donation or sign up for regular donations of a certain amount, which can be canceled:
  • by clicking the "Unsubscribe" button on the Site.
  • by filling in the mailbox to which the subscription was issued.
  • by confirming the cancellation of the subscription in the received email by clicking the "Unsubscribe" button in the email confirming the subscription.
  • Payments on the Site are made through payment service providers. If the Benefactor follows a link to make a payment, he must comply with the terms of use, privacy policy and other policies of such providers.
  • By accepting the Offer, the Benefactor confirms that he agrees with all the terms of the Offer, and is fully aware of and agrees with the subject matter and terms of the Agreement.
  • Collaborative donations are provided by Benefactors and used by the Foundation to carry out the Foundation's charitable activities in accordance with its Charter and the legislation of Ukraine. The Benefactor agrees to such a purpose of their donation.
  • The charitable donation is voluntary and is not subject to further return to the Benefactor.
  • In the event of failure to receive the amount specified in the purpose of the project's collection, the amount will be used to implement this project in the corresponding amount that was collected or will be directed to the implementation of other projects of the Foundation.
  • By making a Charitable Donation to a target charitable project, the Benefactor consents to the redistribution/use of the Charitable Donation in other charitable projects of the Foundation in accordance with the objectives of the Foundation's statutory activities.

5. RIGHTS AND OBLIGATIONS OF THE FUND
   • The Fund has the right:

• receive charitable donations and use them for the purposes specified in its Charter, this Agreement and the Law of Ukraine “On Charitable Activities and Charitable Organizations”;
• change the purposes of using donations within the framework of the Foundation's statutory activities;
• use part of the funds received to finance administrative expenses in accordance with the requirements of Ukrainian legislation;
  • The Fund is obliged to:
• use donations in accordance with the Charter, the Agreement and the Law of Ukraine “On Charitable Activities and Charitable Organizations”;
• at the request of the Benefactor, provide information on the use of the charitable donation.

6. RIGHTS AND OBLIGATIONS OF A BENEFICIARY
   • The benefactor has the right:

• request information about the use of a charitable donation provided by the Benefactor.
  • The benefactor is obliged to:
• to make donations in accordance with the Agreement and the laws of Ukraine.

7. TERM OF VALIDITY OF THE AGREEMENT
   • This Agreement shall enter into force from the moment of acceptance of the Offer by the Benefactor and shall be valid until its full implementation by the Parties.
8. AMENDMENTS TO THE AGREEMENT
   • The Foundation has the right to amend the terms of this Agreement without prior notice by publishing an updated version of the Agreement on the Site. In such case, the updated terms of donation shall be binding on the Benefactor from the moment of publication of the revised version of this Agreement, unless another effective date is additionally specified at the time of publication.
9. FINAL PROVISIONS
   • When making a donation, the Benefactor may provide (optionally) the following personal data: name and surname, e-mail address. Also, if the donation is made by transferring funds to the Foundation's account, the Benefactor's bank details will be provided to the Foundation.
   • In the event that the Benefactor provides the Foundation with the above-mentioned personal data, consent to their processing shall be deemed to have been given by the Benefactor. The Foundation undertakes not to disclose the Benefactor’s personal data to third parties without the Benefactor’s permission, except in cases where such disclosure is required by state authorities or otherwise required in accordance with the legislation of Ukraine. The Benefactor confirms that they have been informed of the rights established by the Law of Ukraine “On Personal Data Protection”. The Benefactor knows and understands the Benefactor’s rights as a subject of personal data in accordance with the Law of Ukraine “On Personal Data Protection”.

Information regarding charitable contributions:

1. Charitable collections within the framework of the Foundation's programs and projects are unlimited and valid for the entire period of the program or project's existence, until the official notification of the termination of the program or project on the Foundation's website.
2. If the program or project is not implemented, the funds go into a general fund, the distribution of which is carried out according to the priorities for providing assistance, which are determined by the Fund's supervisory board.
3. A person who makes a contribution to a specific program or project gives their consent to the redistribution/use of funds in other projects (if the previous fundraising is no longer relevant, or the program or project is no longer active)
4. By making a charitable contribution, you agree that the donation amount is non-refundable.
